Decision due on Torres Strait Island climate case

The Federal Court will deliver its long-awaited decision on the Torres Strait climate case this Tuesday afternoon in Cairns.

Filed in 2021 by Traditional Owners Uncle Paul Kabai and Uncle Pabai Pabai, the case argues the Australian Government has failed to protect Torres Strait communities from climate change.

Uncle Pabai, a Guda Maluyligal man from Boigu Island, said he launched the case because governments were not listening to the concerns of his community.

"We are witnessing climate change, like erosion and inundation, rapidly getting worse before our eyes," he said.

"If the government continues to do nothing, we will be forced to leave our homelands.

"We'll lose everything - our homes, our culture and who we are."

The ruling will be handed down at 2pm on Tuesday in Courtroom 1 at the Federal Circuit and Family Court of Australia in Cairns.

Seating inside the courtroom is limited to parties involved in the case, however additional rooms will be open for Torres Strait community members and media to view the livestream.

The proceedings will also be streamed on the Federal Court's YouTube channel.

The case seeks court orders requiring the government to cut emissions in line with the best available science to protect island communities.

Expert evidence heard by the court suggested Boigu and Saibai could become uninhabitable within 30 years.

Uncle Paul, a Traditional Owner from Saibai Island, said their islands are already sinking and immediate action is needed.

"It's time now for change, otherwise it will be too late," he said.

A press conference will follow from 3.45pm outside the court's Shield Street exit featuring Uncle Paul, Uncle Pabai, Aunty McRose Elu, the legal team from Phi Finney McDonald and Isabelle Reinecke from Grata Fund.

Traditional performances by Saibai and Boigu dance teams will also take place.
