The Supreme Court of Queensland has ruled that a case brought by Nagana Yarrbayn Wangan and Jagalingou Cultural Custodians Ltd against the Queensland Government can proceed.
Traditional Owner Adrian Burragubba welcomed the decision outside the court, describing it as a significant step forward for the protection of the Doongmabulla Springs.
"Today is a win for us because the state government tried to strike out our claim to show that the mine is affecting the springs," Mr Burragubba said on Friday.
With the case allowed to move ahead, Mr Burragubba explained the custodians are preparing to present detailed evidence in court.
"The way forward is that we still have a legal case that we can take forward, then we bring all the evidence."
He criticised the Queensland Government for failing to act sooner.
"The government failed us by having to get to this point anyway."
Despite the government's attempts to stop the case, Mr Burragubba viewed the decision as a positive outcome.
"By all of their efforts to strike this out, we're calling this a win."
Speaking on the cultural importance of the site, Mr Burragubba said the damage to the Springs is already occurring.
"The truth is that the Carmichael mine is destroying a sacred site, which is special to us and special to all people who visit there."
"This is why there's an urgency in having an environmental protection order placed upon the open cut mine and especially why we're here today."
Looking ahead, Mr Burragubba invited broader community support.
"The process is we still have a legal fight ahead of us and everyone is welcome to join in with us."
When asked about his confidence in the next stage, Mr Burragubba said he remained optimistic.
"I'm feeling very confident — I was confident when I came here because we never trust the government solely when it comes to our cultural heritage, but today, there might be a glimmer of hope with the judge and what they've allowed there today."
"We can put pressure on the government to do their job to enforce the Environmental Protection Act on the open cut mine."
