Torres Strait duo submit evidence to Federal Court in landmark Australian Climate Case

The legal team backing the Torres Strait duo in the landmark Australian Climate Case will today, 17 February, submit evidence in Federal Court.

Lawyers representing Uncle Pabai Pabai and Uncle Paul Kabai from Boigu and Saibai Islands in the Torres Strait collected evidence from community members as part of their case.

In October 2021 Uncle Pabai and Uncle Kabai filed a case against the Australian government and argued the Commonwealth has a legal duty of care, arising from negligence law, to ensure Torres Strait Islander peoples are not harmed by the climate crisis.

This is the first such case brought against the entire Commonwealth Government.

The duo are seeking an order from the court requiring the government to prevent the harm to their community by cutting greenhouse gas emissions.

An on Country hearing is due to take place in Boigu, Saibai and Cairns in June of this year.
